Applicable Rules for Half Pay Leave (HPL) in Haryana

Rule 37 (Half Pay Leave): This rule applies to eligible non-teaching employees governed by Rule 37. It provides for the grant of 20 days of Half Pay Leave for every completed year of qualifying service. The credit becomes due only after completion of the service year and is linked to the employee’s service anniversary, not to the calendar year.

Rule 36 (Vacation Wing – Special Provision): Employees belonging to the Vacation Wing, such as teaching staff in government schools or colleges, are governed by special leave provisions. Under this rule, Earned Leave is granted in lieu of leave admissible under other rules. As a result, standard Half Pay Leave is generally not applicable to Vacation Wing staff. Accordingly, this calculator displays the status as “Not Admissible” when the Teaching category is selected.

Rule 35 (Earned Leave – Contextual Reference): Rule 35 governs the grant of Earned Leave based on duty periods and prescribed credit cycles. How Half Pay Leave (HPL) Is Calculated in Haryana

A. The “Anniversary” Credit (Rule 37)

Unlike Earned Leave, which is calculated based on the period spent on duty (Rule 35), Half Pay Leave (HPL) functions on a Service Anniversary basis. You earn 20 days only after the completion of one full year of qualifying service.

Example: If an employee joined on July 10th, the 20-day HPL credit accrues every year on July 10th.

B. The Effect of Non-Qualifying Service

If an employee has unauthorized absence or a break in service that is not condoned, the “completed year” is delayed.

Mechanism: If an employee was absent without authorization for 15 days, the HPL credit date shifts from July 10th to July 25th. This calculator automatically adjusts the “Effective Anniversary” to account for this shift.

(Note: Extraordinary Leave (EOL) is counted as service for HPL under Rule 9(6) and does not shift the HPL anniversary date, unlike Earned Leave where EOL reduces the leave earned.)

Special Cases Explained (Half Pay Leave – HPL)

1. Teaching Staff of Vacation Wing

Teaching staff in the Vacation Wing are not eligible for standard HPL. They receive Earned Leave in lieu. The calculator excludes the “Teaching” category from HPL calculations to align with this rule.

2. Commuted Leave (Rule 38)

Commuted Leave allows an employee to take full pay on medical grounds, but the debit is doubled.
